Handlesman\u2019s cartoon, a judge is presiding over a jury trial where the attorneys for both parties have fallen asleep (or passed out) at their tables. The jurors, the witness, and the judge are all looking at these two unconscious advocates, and the judge is speaking.<\/p>\n<p>When an attorney finishes presenting his case he \u201crests,\u201d and my first and most obvious captions allude to that term:<\/p>\n<ul>\n<li><strong>\u201cIt appears that both parties have rested.\u201d<\/strong><\/li>\n<li><strong>Apparently, both parties have rested.\u201d<\/strong><\/li>\n<\/ul>\n<p>I next imagined that the witness had put the attorneys to sleep with his testimony, and that the judge was admonishing him to keep his answers brief:<\/p>\n<ul>\n<li><b>\u201cTry to avoid long narratives.\u201d<\/b><\/li>\n<li><strong>\u201cThe court will once again instruct the witness to keep his answers brief.\u201d<\/strong><\/li>\n<\/ul>\n<p>An \u201cinterested party\u201d has a stake in the outcome of litigation, but neither of Handleman\u2019s attorneys seems very involved:<\/p>\n<ul>\n<li><b>\u201cIt appears we have no interested parties.\u201d<\/b><\/li>\n<li><strong><b>\u201c<\/b>Neither party appears interested.\u201d<\/strong><\/li>\n<\/ul>\n<p>A similar caption has the judge addressing the witness: <b>\u201cYou\u2019re not a very interesting interested party.\u201d\u00a0<\/b><\/p>\n<p>I then put a spin on the common term for a practicing lawyer: <b>\u201cMembers of the jury, these are attorneys-at-ease.\u201d<\/b><\/p>\n<p>Finally, I presumed that the witness was a criminal defendant receiving some advice from the bench: <b>\u201cIf you\u2019re convicted, you\u2019ll have a great \u2018ineffective assistance of counsel\u2019 claim.\u201d<\/b> The problem with that caption, aside from the fact that it\u2019s not funny, is that the prosecuting attorney is also asleep.<\/p>\n<p>Now, let\u2019s see how you did:<\/p>\n<p>There were many, many \u201cboth parties have rested\u201d captions. Here\u2019s a small sample of the best:<\/p>\n<ul>\n<li><b>\u201cApparently, both the prosecution and the defense rest.\u201d<\/b><\/li>\n<li><strong>\u201cApparently, the prosecution and defense rest.\u201d<\/strong><\/li>\n<li><strong>\u201cIt would seem that both the prosecution and the defense rest.\u201d<\/strong><\/li>\n<li><strong>\u201cI take it the defense rests as well?\u201d<\/strong><\/li>\n<li><strong>\u201cWell, I see both counsels rest.\u201d<\/strong><\/li>\n<li><strong>\u201cThe Prosecution and Defense both rest.\u201d<\/strong><\/li>\n<li><strong>\u201cCounsels for the Prosecution and the Defense rest.\u201d<\/strong><\/li>\n<\/ul>\n<p>There were also quite a few captions that assumed the witness had put the attorneys to sleep with his long-winded and dull testimony. I especially liked these entries:<\/p>\n<ul>\n<li><b>\u201cThe court appreciates your exhaustive testimony on the legality of mattress tag removal.\u201d<\/b><\/li>\n<li><strong>\u201cAre there any further questions for the accountant?\u201d<\/strong><\/li>\n<li><strong>\u201cThe court finds the defendant\u2026boring.\u201d<\/strong><\/li>\n<li><strong>\u201cThe witness is directed to keep his answers brief.\u201d<\/strong><\/li>\n<\/ul>\n<p>Several of you incorporated a clever reference to the written exam every lawyer must take before getting licensed, while presuming that the attorneys in this cartoon did not fall asleep so much as pass out:<\/p>\n<ul>\n<li><b>\u201cI guess they didn\u2019t pass the bar last night.\u201d<\/b><\/li>\n<li><strong>\u201cLooks like they didn\u2019t pass the bar last night.\u201d<\/strong><\/li>\n<li><strong>\u201cThere\u2019s no bar they\u2019ve ever passed.\u201d<\/strong><\/li>\n<li><strong>\u201cAll they had to do was pass the bar.\u201d<\/strong><\/li>\n<li><strong>\u201cI wish they\u2019d passed the bar.\u201d<\/strong><\/li>\n<\/ul>\n<p>I like all three variations on this joke:<\/p>\n<ul>\n<li><b>\u201cI\u2019ll accept any motion at this time.\u201d<\/b><\/li>\n<li><strong>\u201cDoes either side wish to make a motion?\u201d<\/strong><\/li>\n<li><strong>\u201cSomeone make a motion.\u201d<\/strong><\/li>\n<\/ul>\n<p>While the next six captions don\u2019t fit neatly into any category, they\u2019re all good and they all surprised me:<\/p>\n<ul>\n<li><b>\u201cWould the jury like to question the witness?\u201d<\/b><\/li>\n<li><strong>\u201cTomorrow, I go back to using a gavel.\u201d<\/strong><\/li>\n<li><strong>\u201cThey really couldn\u2019t handle the truth.\u201d<\/strong><\/li>\n<li><strong>\u201cLooks like both parties hired legal dream teams.\u201d<\/strong><\/li>\n<li><strong>\u201cBailiff! Sharpie!\u201d<\/strong><\/li>\n<li><strong>\u201cI declare a missed trial.\u201d<\/strong><\/li>\n<\/ul>\n<p>But to my mind the best entry was, <b>\u201cI wish they\u2019d passed the bar.\u201d<\/b><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the late J.B.
